<h2>What &#8216;as-of-right&#8217; really means for a legal basement apartment permit in Toronto</h2>
<p>As-of-right is the single most misunderstood phrase in Toronto real estate. It does <em>not</em> mean &#8220;no permits.&#8221; It means the City has pre-approved a use — such as a secondary suite — in your zoning category, so you do not need a Committee of Adjustment variance or an Official Plan amendment to do it. You still need a building permit, you still need inspections, and you still must satisfy every line of the Ontario Building Code.</p>

<p>Since the 2022–2023 zoning bylaw update, the City of Toronto permits up to two residential units on most residential lots as-of-right: a primary dwelling and one secondary suite. In many low-rise zones, a garden suite or laneway suite is also allowed as a third unit.
